The petitioner seeks regular bail in connection with Laheriasarai P.S. Case No. 492 of 2017, registered for the offence punishable under Sections 401, 411, 414, 420, 467, 468, 471, 120(B) of the Indian Penal Code and Sections 25(1-B)(a) 35 of the Arms Act.
The allegation against the petitioner is that he is having a criminal gang and is involved in regular loot of two wheeler vehicles, ornaments, money, mobile etc. and in the present case also, the petitioner has been found to have committed loot and the police has recovered incriminating articles from the possession of the petitioner.
The learned counsel for the petitioner submits that the petitioner is innocent and he is languishing in custody since 28.11.2017. Nonetheless, the learned counsel for the petitioner,
Patna High Court Cr.Misc. No.23315 of 2018(4) dt.03-07-2018 2/2 upon suggestion made by this Court, submits that the petitioner is ready to deposit a sum of Rs. 1,00,000/- with the Nazarat of the concerned court subject to the result of this case, for the purposes of grant of bail.
Having regard to the facts and circumstances of the case as also the fact that the petitioner is an accused in five cases of similar nature, I find that it would be in the interest of justice to direct the petitioner to deposit a sum of Rs. 1,00,000/- with the Nazarat of the concerned court. First installment of Rs. 50,000/- shall be deposited on or before 3rd of August, 2018 and the second installment of Rs. 50,000/- shall be deposited on or before 4th of September, 2018. After the deposit of the said amount of Rs. 1, 00,000/- and upon showing the receipt of deposit of the said amount, the petitioner would be released on regular bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga, District-Darbhanga in connection with Laheriasarai P.S. Case No. 492 of 2017. It is needless to state that the aforesaid deposit of Rs. 1,00,000/- shall be subject to the final outcome of this case. (Mohit Kumar Shah, J) ajay gupta/- U T
