Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 47(a)(f)/13(f) of the Excise Act and under Rules 2(e) 3 5(b) (Bihar Mahua Flowers) Rules, 2006.
1100 Kgs of Mahua flowers were seized being transported through auto rickshaw.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that Mahua Flowers belong to the petitioner as petitioner is neither connected with auto rickshaw nor with the Mahua Flowers. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.32581 of 2015 (2) dt.10-08-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh-Gaya/Cherki P.S. Case No. 188 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
