The petitioner is languishing in custody since 4.7.2019 in a case registered for the offences punishable under Sections 25 (1B) a and 26 of the Arms Act. It is alleged that three persons including the petitioner were travelling on the motorcycle and when they were tried to stop, they started fleeing away. It is alleged that one country made pistol and five cartridges were recovered from the place from where the petitioner and others were going on motorcycle. It is submitted by learned counsel for the petitioner that the petitioner has maliciously been implicated in the case. Though the petitioner is accused in twenty six cases but in most of those cases, he is either on bail or has been acquitted. Considering the nature of accusation and the period

No.54808 of 2019(3) dt.20-11-2019 2/2 in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Buxar in connection with Brahampur (Krishna Brahm) P.S. Case No.154 of 2019.

However, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on two consecutive occasions or if he gets involved in a case of similar nature.
