This is an application for bail in connection with Piar P.S. Case No. 98 of 2017 registered for the offences punishable under Sections 25(1-B)(a) and 26 of the Arms Act.

Allegation against the petitioner is of recovery of one loaded pistol.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for about five months. Further submission is that he has been made accused in one more case but he is on bail in that case. Heard learned APP also.

Having heard both sides and in the facts and circumstances of the case, I am not inclined to grant bail to the

Patna High Court Cr.Misc. No.62667 of 2017 (2) dt.12-01-2018 2/2 petitioner at this stage.

However, learned trial court is directed to expedite the proceeding and once charge has been framed against the petitioner or petitioner completes six months period in custody, whichever is earlier, the court below shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
