ANJANA MISHRA ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in a case registered for the offences under Sections 452, 384, 386 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that a false and malicious allegation has been made against the petitioner that he has taken out Rs.500/- from the pocket of the informant's son. Learned counsel further submits that though the occurrence is of the year 2009, till date the investigation is going on and the petitioner is apprehending his arrest on account of some vague and malicious allegation made by the informant, who is a land Mafia.

No.32654 of 2015 (2) dt.19-08-2015 2/2 Considering the aforementioned facts and circumstances also the fact that the petitioner has got no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case No.333 of 2009, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
