JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 33-1(a), 41 and 42 of the Indian Forest Act (Bihar Amendment 1989).

Allegation against the petitioners is of illegally cutting and taking away wood from Dibu Basera Forest. It has been submitted on behalf of the petitioners that they have no criminal antecedent. They have been made accused due to mistake of fact. Petitioners denied allegation made in the F.I.R. It is further submitted that petitioners are ready to deposit an amount of Rs. 20,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is

Patna High Court Cr.Misc. No.39594 of 2015 (2) dt.29-09-2015 2 / 2 directed that petitioners shall deposit Rs. 20,000/- in the court below which shall be subject to the final disposal of the case. Let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Pramod Kumar Pandey. learned Judicial Magistrate, Ist Class, Gaya, in connection with Forest Case no. 158 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
