The petitioner, already in custody, seeks bail in connection with Patori P.S.Case No. 60 of 2017 registered under Sections 8, 15, 18, 46, 47 and 48 of the N.D.P.S.Act. Allegation in brief is that petitioner was found having cultivated opium in three plots.
Submission is that plots were given to someone for cultivation and petitioner had no knowledge about it. Learned counsel for the State submits that in plots belonging to the petitioner, opium was found planted and there is nothing to show that it was given to someone else for cultivation.
Whereas learned counsel for the petitioner submits that similarly situated co-accused persons Krishna Kumar Singh, Vishwajeet Sarkar, Jibachh Rai and Bhonu Ray have been
Patna High Court Cr.Misc. No.13188 of 2018(4) dt.03-05-2018 2/2 admitted to bail by the co-ordinate Benches of this Court vide Cr. Misc. No. 25918 of 2017, 28649 of 2017, Cr. Misc. No. 38997 of 2017 and 40379 of 2017 respectively. Having considered the aforesaid facts and circumstances, the petitioner, namely , Medni Rai, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-1st, Samastipur in connection with Patori P.S. Case No. 60 of 2017 (NDPS No. 17 of 2017) with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
