The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have assaulted the informant by dabiya, as a result of which, head of the informant fractured. It is further alleged that all the accused entered in the house of informant and looted away cash and other valuable articles.

It is submitted on behalf of petitioner that there is case and counter case. Counter case i.e. Murliganj P.S. Case No. 411 of 2018 has been lodged by the mother of petitioner against informant and others. Police, after investigation, submitted final

Patna High Court CR. MISC. No.67079 of 2021(2) dt.24-05-2022 2/2 form against the petitioner. In fact, on the date of occurrence, petitioner was not present at the place of occurrence, rather being S.I. of Police and at the relevant time, he was on duty at Gaya. Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the fact that petitioner is government employee and has got clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Madhepura in connection with Murliganj P.S. Case No. 402 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
