Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual mode.
The petitioner seek regular bail in connection with Hussainganj ( M.H. Nagar) P.S. Case No. 273 of 2020 lodged
Patna High Court CR. MISC. No.66807 of 2021(3) dt.18-11-2022 2/3 under Sections 498, 304(B), 201/34 of the I.P.C. read with Section 3⁄4 of the Dowry Prohibition Act.
As per the prosecution case, The F.I.R. has been lodged against total 8 family members of the petitioners for dowry death of his daughter-in-law whose marriage was solemnized with his son Nagendra Yadav.
Learned counsel for the petitioners submit that petitioners are innocent and have committed no offence. Learned counsel submits that petitioner of first case is the father-in-law whereas petitioner of second case is the brother-inlaw of the deceased. The antecedent of both father-in-law and brother-in-law are clean and they are in custody since 22.07.2021 and 21.09.2021 respectively. Charge sheet has already been filed in this case. Learned counsel submits that from the F.I.R., it transpires that there is a general and omnibus allegation against the petitioners. It has also been submitted that the husband of the deceased is already in custody. Learned counsel for the State opposes the prayer for bail and submits that it is true that there is a general and omnibus allegation against these 2 petitioners. Patna High Court CR. MISC. No.66807 of 2021(3) dt.18-11-2022 3/3 granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Siwan in connection with Hussainganj ( M.H. Nagar) P.S. Case No. 273 of 2020 , subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
