Permission is accorded.

Heard learned counsel for the petitioner no. 1 and learned A.P.P. for the State.

Let the defect(s), if any, be removed within a period of four weeks.

The petitioner no. 1 apprehends his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307, 504, 506 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner no. 1 submits that petitioner no. 1 has antecedent of one case. The informant has

No.66941 of 2021(2) dt.20-07-2022 2/2 implicated sixteen persons as accused with general and omnibus allegation in the FIR and the specific allegation of firing is against Hari Narayan Singh as a result of which the informant was injured. It is next submitted that a Title Suit No. 1011 of 2018 is pending between the family of the informant and the petitioner no. 1. It is further submitted that similarly situated co-accused Arjun Singh has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 16.06.2022 passed in Cr. Misc. No. 68073 of 2021. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner no. 1, the petitioner no. 1 above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bidupur P.S. Case No. 421 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
