JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Chhatapur P.S. Case No. 143 of 2014 registered for the offences punishable under Sections 420, 467, 468, 471/34 of the Indian Penal Code.

At the relevant time the petitioner was the headmaster and he was the member of the Selection Committee and that Selection Committee appointed one Chandan Devi on the basis of forged certificate.

Submission is of false implication and that in this case similarly situated co-accused Msidhwani Toppo has been allowed pre-arrest bail vide order dated 08.01.2015 passed

Patna High Court Cr.Misc. No.48826 of 2014 (6) dt.23-04-2015 in Cr. Misc. No. 607 of 2015 by another Bench of this Court and as such the petitioner deserves sympathetic consideration to which the learned APP opposes.

In the facts and circumstances stated above, considering that the petitioner was only the member of the Selection Committee and it was co-accused Chandan Devi who produced forged certificate, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Supaul in connection with Chhatapur P.S. Case No. 143 of 2014, subject to the conditions as laid down under Section 438

(2) of the Cr.P.C.
