The petitioner seeks bail in connection with Chiraiya P.S. Case No. 302/2017 dated 22.09.2017 instituted for the offences under Sections 30(a) and 37(a) of the Bihar Prohibition and Excise Act, 2016.
From the possession of the petitioner, several litres of country made liquor was recovered. Though, the petitioner disputes the aforesaid seizure, but it appears that he was caught selling liquor to people.
However, taking into account the period of custody of the petitioner, which is from 23.09.2017 and that he does not bear any criminal antecedent, this Court is inclined to grant bail to the petitioner.
Patna High Court Cr.Misc. No.55585 of 2017 (2) dt.30-11-2017 2/2 Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII, Motihari in connection with Chiraiya P.S. Case No. 302/2017.
