The petitioner is apprehending his arrest in connection with Palanwa P.S. Case No.45 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 307, 373, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present case has been lodged on flimsy premises as the nature of the dispute only involved is with regard to the use of thresher for cutting the crops. Learned counsel further submits that the petitioner has no criminal antecedents and there is no injury, as alleged in the F.I.R Considering the aforementioned facts and
Patna High Court Cr.Misc. No.32308 of 2015 (2) dt.17-08-2015 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri N.K. Priyadarshi, learned Judicial Magistrate, 1st Class, Raxaul at Motihari, in connection with Palanwa P.S. Case No.45 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
