====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner, counsel for the informant and the State.
The petitioner seeks bail in Barauni P.S. Case No. 221 of 2019, instituted for the offence under Section(s) 494 and 498A of Indian Penal Code.
It is alleged in the written report that informant was married with petitioner. After marriage, two sons were born from the wedlock in the years 1996 and 1998 respectively. Petitioner used to commit torture with the informant and ousted her along with two sons from his house. It is further alleged that petitioner has performed another marriage and has been living with his second wife.
Counsel for the petitioner submits that petitioner is

Counsel for the informant has appeared and submitted that informant is ready to live with this petitioner in the event she is provided proper accommodation and taken care of by the petitioner.
In such circumstances, the petitioner above named is directed to be released on Provisional bail for a period of six months on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 221 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
The petitioner after release on bail shall go to the Maikey of the informant and bring his wife (informant) and children to live with him and shall take proper care of wife and sons. The court below will monitor relationship between petitioner and informant by calling both of them every month in court. In the event court below is satisfied that petitioner is keeping his wife (informant) and his two sons with full dignity and care, the provisional bail granted to the petitioner shall be
