The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447, 448, 341, 323, 324, 307, 379, 325 and 34 of the Indian Penal Code. Accusation is of entering into the house of the informant, make assault to the informant's side and took away Rs.20,000/- and jewellary.

It is submitted by learned counsel for the petitioners that though three persons received injury from the informant's side but the injury was found to be simple. There is counter version of the occurrence also in the background of land dispute

Patna High Court Cr.Misc. No.34092 of 2015 (2) dt.25-08-2015 2/2 and the petitioners being the agnates of the informant have been roped in the present case. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikarhana at Motihari in connection with Rajepur P.S. Case No.3 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
