ANJANA MISHRA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Sasaram (M) P.S. Case No.595/15 for the offences under Sections 147, 148, 149, 323, 324, 326,337, 338, 353, 307, 427, 379, 120-B of the I.P.C., Section 27 of the Arms Act, 4/40 of the Bihar Mining Act and 33, 41 and 42 of the Indian Forest Act.
The case diary of this case which was called for has since been received.
Learned counsel for the petitioner submits that general and omnibus allegation has been made against 52 named accused persons along with 25-30 unknown persons. Petitioner is one of the named accused persons. He further submits that this
Patna High Court Cr.Misc. No.35540 of 2015 (4) dt.01-12-2015 2/2 Court after hearing the parties and considering the materials on record this Court was pleased to extend the privilege of anticipatory bail to similarly situated co-accused persons including Dheeraj Kumar @ Dheeraj Mahto vide Cr.Misc.No.35012 of 2015 on 19.8.2015. Similarly situated four other persons, namely, Hira Sah, Sanjeev Kumar, Kanhaiya Singh and Santosh Singh having no criminal antecedent similar have already been extended the privilege of anticipatory bail vide Cr.Misc. No.37775 of 2015 on 21.9.2015 including one Ramesh Choudhary vide Cr.Misc. No.37865 of 2015 on 21.9.2015. He further submits that the petitioner is also having no criminal antecedent like other coaccused persons.
Considering the aforesaid facts and circumstances and submissions of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Rohtas at Sasaram, in Sasaram (M) P.S. Case No.595 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
