The petitioner being the younger brother of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The accusation is of killing the niece of the informant by administering poison.
It is submitted by learned counsel for the petitioner that the petitioner is separate from the husband of the victim and admittedly the informant is not the eye witness of the occurrence. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.6253 of 2016 (2) dt.09-02-2016 2/2 Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Masaurhi, Patna in connection with Punpun P.S. Case No. 203 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
