ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.01.2019 in connection with Haspura P.S. Case No. 06 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were made joint the family house and not from the conscious possession of the petitioner. It is further submitted that save and except one other case the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.52959 of 2019(3) dt.27-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional Sessions Judge VII-cum-Special Judge, Excise Aurangabad in connection with Haspura P.S. Case No. 06 of 2019.
