JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 427 and 506/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that on 25.07.2015, the informant went to the office of the petitioner who is a Junior Engineer in the Electricity Department, Chakai and asked the reason for calling the informant when the informant was abused by calling caste name, pushed out from the office and was also demanded `5,000/- for retaining the electricity connection. It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.6286 of 2016 (2) dt.09-02-2016 2/2 for the occurrence of 25.07.2015, the FIR was lodged on 29.7.2015. The petitioner filed Chakai P.S. Case No. 95 of 2015 levelling accusation under Sections 452, 341, 323, 353, 427, 506, 379 and 511/34 of the IPC against the Panchayat Mukhiya and the witnesses of the present case, hence the accused of the FIR lodged by the petitioner set up the present informant to lodge the present case.

Considering the delayed lodging of the case and the case lodged by the petitioner's side against the witnesses of the present FIR at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui in connection with Jamui (SC/ST) P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
