The petitioner seeks bail in connection with Bhagwanpur (Vaishali) P.S. Case No. 171/2017 dated 22.09.2017 instituted for the offence under Section 379 of the Indian Penal Code.
A pick-up van was stolen. During the course of investigation, one co-accused was arrested from whom another vehicle was recovered. On his statement, a raid was made in the go-down of the son of the petitioner, from where looted articles were recovered. The petitioner is a retired government servant and is not at all aware of the fact that in the go-down of his son certain stolen articles were kept.
Learned counsel for the petitioner has drawn the attention of this Court to various medical prescriptions and test
Patna High Court Cr.Misc. No.62700 of 2017 (2) dt.21-12-2017 2/2 reports showing that the petitioner is not having good health. The petitioner is in custody since 08.10.2017. Regard being had to the facts that the petitioner has no criminal antecedent and recovery of stolen article is from the godown of the son of the petitioner, this Court is inclined to grant bail to him.
The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur (Vaishali) P.S.
