The petitioners have preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, 225 litres of Nepali
Patna High Court CR. MISC. No.66770 of 2021(2) dt.26-04-2022 2/2 liquor and 12 litres of beer was recovered from the vehicle and both the petitioners in the said vehicle were taken into custody. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their possession. They have been falsely implicated in the case. They have no criminal antecedent and are in custody since 3.10.2021. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent and having remained in custody for more than 6 months, the Court directs both the petitioners to be enlarged on bail in connection with Jaynagar P.S. Case no.269 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Excise Act, Madhubani.
