Mr. AMRENDRA PRASAD ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for offences punishable under Sections 353/308/34 of the I.P.C. and Section 37 (b) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, one bottle containing 750 ml. of royal stag was recovered from the bolero jeep on which the petitioners were boarding in drunken state. On the same date, another case bearing Banka P.S. Case No.592 of 2017 was also lodged against 6 persons. It is contended that petitioner no.1 is the driver of the vehicle. It is further contended that save and except the aforesaid two cases which were lodged on the same date, antecedents of the petitioners are

Patna High Court Cr.Misc. No.54847 of 2017(2) dt.23-11-2017 2/2 clean. Petitioners claim that they are in custody since 15.09.2017, i.e., more than two months.

Having regard to the facts and the circumstances of the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Banka, District, Banka in connection with Banka P.S. Case No. 593 of 2017 with a further condition that one of the bailors must be belonging to the State of Bihar.

Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
