The petitioner apprehends his arrest in connection with Pipra P.S. Case No.30 of 2014 registered under Sections 302/34 of the Indian Penal Code.
The accusation is that the co-accused, Prabhu Sah, Navin Kumar and this petitioner, respectively being the father, brother and sister-in-law of Arvind Kumar, brutally assaulted Arvind Kumar, as a result of which he became unconscious and died in the hospital.
Learned counsel appearing on behalf of the petitioner submits that the informant, who is the cousin father-in-law of the
Patna High Court Cr.Misc. No.46390 of 2014 (4) dt.14-05-2015 2/2 petitioner, has falsely implicated the petitioner in this case with an ulterior motive. In fact, Arvind Kumar sustained injury due to falling down on the earth in drunken state and died due to that injury. It is further submitted that the co-accused, Prabhu Sah and Navin Kumar, have already been granted to the privilege of bail by this Court vide order dated 09.01.2015 passed in Criminal Misc. No.32081 of 2014.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within four weeks, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, East Champaran, Motihari, in connection with Pipra P.S. Case No.30 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
