The petitioner seeks bail in Madhepura P.S. case No.252 of 2015 registered under Sections 420, 409, 406, 467, 468, 120B of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Madhepura.

Allegation is that the accused persons embezzled the government money after opening forged National Child Labour Schools in the name of providing education, dress and food to the students.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.06.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has

There is no substantive evidence to suggest that wrongful gain was made on behalf of the petitioner or had caused wrongful loss to any person. The petitioner was an employee of N.G.O. in question. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. In collusion with other accused persons on paper N.G.O. was created as National Child Labour Project School. In several Blocks of Madhepura District Rs.5000/- to 10,000/- were taken for the purpose of giving jobs. Ultimately National Human Rights Commission, New Delhi came to know about the same and on enquiry it was found that the accused persons by way of fraud cheated poor people of District Madhepura on the name of giving employment. Considering the nature of allegations, I am not inclined to grant bail to the petitioner at this stage. The same is rejected.
