JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code.

The prosecution case, lodged by the Circle Officer, is to the effect that in 107 Cr.P.C proceeding, during enquiry, it was found that one of the parties to 107 Cr.P.C proceeding claiming the land in question on the basis of the sale deed which was executed by an imposter impersonating the land lady Ambika Devi. The sale deed was executed in 2007-08 when the petitioner signed as identifier on the sale deed.

It is submitted by learned counsel for the petitioner that the vendor and vendee of the said sale deed have been granted anticipatory bail by learned Court below and the

Patna High Court Cr.Misc. No.6338 of 2016 (2) dt.09-02-2016 2/2 whole accusation is based on the enquiry report of the Halka Karamchari.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 23 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
