This is an application for bail in connection with Warisaliganj P.S.Case No. 135 of 2016 registered for the offences punishable under Section 395 of the Indian Penal Code and later on Section 412 IPC was added.
Allegation is of snatching bag of the informant containing ornaments by the accused persons on the point of pistol.
Submission of learned counsel for the petitioner is that on the basis of confessional statement of co-accused he has been made accused in this case and except that there is nothing against him and there is no recovery from his possession and he is in custody since 10.8.2016. Further submission is though he is made
Patna High Court Cr.Misc. No.55029 of 2017 (2) dt.20-11-2017 2/2 accused in another case but he is on bail in that case. Heard learned APP also.
Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Nawada, in connection with Warisaliganj P.S.Case No. 135 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
