2. The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 168 of 2023 dated 01.07.2023, lodged under Sections 147, 148, 149, 341, 323, 307, 302, 504 of the Indian Penal Code.
3. As per the prosecution story, FIR has been lodged against 11 named accused persons including the present petitioner against whom there is an allegation that they have attacked the informant's husband due to which he died.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that there is no direct allegation against the present
Patna High Court CR. MISC. No.59421 of 2024(2) dt.14-08-2024 2/2 petitioner and the specific allegation is against one Rajesh Choudhary who assaulted by lathi, danda on the head of the informant's husband. Counsel further submits that the criminal antecedent of the petitioner is clean and he is in custody since 26.06.2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In the present facts and circumstances of this case, let the petitioner above named be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Katihar in connection with Amdabad P.S. Case No. 168 of 2023, subject to the conditions as laid down U/s 437(3) Cr.P.C.
