ANJANA MISHRA ORAL ORDER 17-08-2015 Both the aforesaid cases which arise out of one and the same F.I.R. have been heard together and are being disposed of by this common order.

Heard learned counsel for the petitioners as well as

Patna High Court Cr.Misc. No.34256 of 2015 (2) dt.17-08-2015 2/3 learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in connection with Rajauli P.S. Case No.109/15 instituted for the offences under Sections 420, 467, 468, 469 471 and 120(B) of the I.P.C.

Learned counsel for the petitioners submits that an F.I.R. was lodged stating that some persons who were running a Pan Shop have been indulging in preparing fake papers so as to enable trucks to pass the integrated Check-post at Rajouli. It is submitted that recovery of Laptop and invoices were made from beetle shop of one Guddu Kumar and on chase some other persons were caught from the place of occurrence.

Learned counsel for the petitioner submits that though these petitioners have no concern with the aforementioned act of preparation of any fake paper, the names of these petitioners were taken by some of the accused persons who were caught at the place of occurrence. He further submits that there is no iota of evidence so as to implicate these petitioners save and except, the statement made by the said accused persons. He further submits that the petitioners have no criminal antecedent and have no concern with the preparation and use of such fake document as has been alleged in the first information report.

No.34256 of 2015 (2) dt.17-08-2015 3/3 Considering the aforementioned facts and circumstances and also the fact that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest/surrender within a period of three weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Nawada, in Rajauli P.S. Case No.109/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Anjana Mishra, J) AnilKrSinha/- U T
