The petitioner is accused in connection with Mohiuddinnagar P.S. Case No. 191 of 2015, registered under Section 25(1-B)A and 26 of Arms Act.
The accusation is that five live cartridges were found in possession of the petitioner and on search of his house, one loaded country made pistol was also recovered from the container of rice.
Learned counsel appearing on behalf of the petitioner submits that, in fact, at the behest of the Nageshwar Thakur against whom Mohhiuddinnagar P.S. Case No. 192 of 2015 was instituted on the basis of the written report of the
Patna High Court Cr.Misc. No.9120 of 2016 (2) dt.29-03-2016 2/2 informant and on the basis of the written report Mohhiuddinnagar P.S. Case No. 194 of 2015 is instituted against this petitioner. Further submission is that petitioner has no criminal antecedent and he is in custody since 20.10.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Kumar, A.C.J.M. Samastipur in connection with Mohhiuddinnagar P.S. Case No. 191 of 2015. Out of two sureties, one surety must be the parent/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
