JUSTICE RAKESH KUMAR ORAL ORDER 08-04-2016 Heard Sri Krishna Prasad Singh, learned senior counsel, who was assisted by Sri Rakesh Singh, learned counsel for the petitioner, Smt. Veena Rani Prasad, learned A.P.P. as well as Mr. Md. Najmul Hoda, learned counsel, who has voluntarily appeared on behalf of the informant.

The petitioner, who is in custody since 10.11.2015 in connection with Rajoun P.S. Case No. 246 of 2015 registered for the offence under Section 366(A) of the Indian Penal Code has prayed for grant of bail.

It was submitted by learned senior counsel for the petitioner that four days after recovery of the victim girl her statement under Section 164 Cr.P.C. was recorded and as such it can be inferred that by influence statement was got recorded

Patna High Court Cr.Misc. No.6925 of 2016 (3) dt.08-04-2016 2/2 against the petitioner.

Learned A.P.P. as well as learned counsel for the informant have opposed the prayer of bail. It was argued that the victim is a minor girl. She was examined by the medical board and she was found minor.

Keeping in view the nature of accusation, I am not inclined to extend the privilege of bail.

The petition stands dismissed.
