Petitioners seek bail in a case registered under Sections 363, 366A, 379, 504, 506/34 of Indian Penal Code. It is submitted by the counsel for the petitioners that the petitioners have falsely been implicated in this case. Submission is that from perusal of the deposition of the victim girls recorded under Section 164 of Criminal Procedure Code, which has been placed at Annexure 2 of the application, it is obvious that they have, on their own volition, accompanied the two accused persons and have in fact married with the accused persons. Even the medical examination report suggests the age of the victim girls between 17-18 years old. Petitioners, having no

Patna High Court Cr.Misc. No.63158 of 2017 (3) dt.21-02-2018 2/2 criminal antecedent, are in custody since 15.07.2017. Considering the aforesaid submissions, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Presiding Officer, Fast Track Court I, Purnea in K Nagar Police Station Case No 369 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
