JUSTICE ARUN KUMAR JHA ORAL ORDER 27-08-2025 Learned counsel for the petitioner submits that the period of custody of the petitioner has been wrongly mentioned in Para-4 of the petition and seek permission to correct the same in course of the day.
02. Permission is accorded.
03. Heard learned counsel for the petitioner and learned APP for the State.
04. In the present case, the petitioner seeks bail in connection with Pandaul P.S. Case No. 113 of 2025 registered for the alleged offences under Sections 310(4), 310(5) of Bharatiya Nyaya Sanhita, 2023 and Section 25(1-b)a, 26, 35 of the Arms Act.
05. As per prosecution case, police received information about some miscreants gathering together for

No.57971 of 2025(2) dt.27-08-2025 2/3 committing dacoity and a raid was conducted at the identified place and three persons including this petitioner have been apprehended and some of the miscreants fled away from the spot. From the possession of this petitioner, one folding knife was recovered. From co-accused, Raju Chaupal, recovery of a country made katta and a mobile phone was made. Three motorcycles were also seized from the spot.
06. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of this petitioner. From the FIR, it is clear that no ammunition was recovered though it is alleged that one country made katta was recovered from the co-accused. The petitioner is in custody since 04.06.2025. The petitioner has got no criminal history.
07. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of allegation against the petitioner and his clean antecedent and also considering the period of custody of the petitioner, he is directed to be released on bail on furnishing bail
Patna High Court CR. MISC. No.57971 of 2025(2) dt.27-08-2025 3/3 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani/court concerned in connection with Pandaul P.S. Case No. 113 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
