JUSTICE BIRENDRA KUMAR ORAL ORDER 26-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Banka P.S. Case No. 150 of 2017, a case under Sections 147, 148, 149, 341, 323, 325, 337, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner allegedly shot fire causing injury at the shoulder of the informant. Petitioner has stated on oath that he had got no criminal antecedent and he is in custody since 31.10.2017. Investigation is complete and the petitioner is ready to co-operate with the trial. There is case and counter case. Considering the entire facts of this case, let the petitioner, above named, be released on bail after completion of

No.62903 of 2017 (3) dt.26-02-2018 2/2 eight months in custody, if the trial is not concluded, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Banka Police Station Case No. 150 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
