According to the prosecution case itself, it was co-accused Nirmal Yadav who took out purse of the informant and while he was chased by the informant, co-accused handed over the said purse to the petitioner.
Admittedly, co-accused Nirmal Yadav has already been granted privilege of bail by learned Sessions Judge itself. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 23.11.2015.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Gaya in GRP Sasaram Railway P.S. Case no. 102/2015. shahid (Hemant Kumar Srivastava,J) U T
