The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 379, 504, 354, 456, 506/34 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused persons came to the house of the informant assaulted and also committed loot of house hold articles as also ornaments. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.6.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. The alleged date of occurrence is 10.04.2019 and the F.I.R. was instituted on 14.4.2019. The delay in lodging the FIR has not been explained. The present case is in

Patna High Court CR. MISC. No.52881 of 2019(2) dt.23-08-2019 2/2 retaliation to Araria Mahila P.S. Case No. 31/19. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 140/19.
