JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 411/414 of the Indian Penal Code.
As per the prosecution case, 430 bags of stolen paddy has been recovered from the go-down of Sumitra Devi and coaccused Pawan Sah has been apprehended on the spot, who disclosed the name of this petitioner.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. It is submitted that petitioner name of petitioner has transpired in this case on the
Patna High Court CR. MISC. No.66979 of 2021(2) dt.28-02-2022 2/2 basis of disclosure made by co-accused, Pawan Sah, who has already been granted bail by a co-ordinate Bench of this court vide order dated 01.03.2017 passed in Cr. Misc. No. 6030/2017. Petitioner is in custody since 03.08.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Vaishali at Hajipur in connection with Goraul PS case No.276/2016.
