2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 80(2) and 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS'), 2023.

3. The case of the prosecution is that the marriage of the sister of the informant was solemnized in the year 2024 with Pujan Das (the petitioner). After two months, the sister of the informant was subjected to cruelty by her in-laws on account of non-fulfillment of dowry demand. On 06.09.2024, informant's sister made a call that the petitioner was threatening to kill her due to non-fulfillment of dowry demand. On the same day at 3 PM, one Suman Das informed the informant that his sister has got electric shock and on next day, Suman informed the informant that his sister has died.

Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that the petitioner was not present at the house, rather he was at some other place on the next date of occurrence. It has also been submitted by the learned counsel for the petitioner that the bail application of this petitioner was rejected vide Cr. Misc. Case No. 84029 of 2024 with a liberty to renew his prayer for bail after six months if the trial does not conclude. Learned counsel further submitted that only charges has been framed. The petitioner is a man of clean antecedent. The petitioner is in judicial custody since 30.09.2024.

5. Learned APP for the State has vehemently opposed the bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Terhagachh P.S. Case No. 98 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Kishanganj.
