JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner as well as learned Standing Counsel-2 for the Vigilance and learned Additional Public Prosecutor for the State.
This application for grant of anticipatory bail arises out of Special Case No. 03 of 2015 arising out of Vigilance P.S. Case No. 10 of 2015, disclosing offences under Sections 409, 420, 467, 468, 471, 477A/34 and 120B of the Indian Penal Code and under Sections 13(2) read with 13(1)(D) of the Prevention of Corruption Act, 1988.
Considering the submission made on behalf of the petitioner that in identical situation two other persons namely
Patna High Court Cr.Misc. No.32400 of 2015 (2) dt.13-08-2015 2/3 Anita and Dr. Saroj Kumar Verma, who were also the members of the Purchase Committee, have been granted anticipatory bail by this Court vide orders dated 17.07.2015 and 31.07.2015 passed in Criminal Miscellaneous Nos. 26015 of 2015 and 31273 of 2015, I do not find any reason to reject the present application for grant of anticipatory bail. I have perused the order passed by this Court dated 28.05.2015 in Criminal Miscellaneous No. 24474 of 2015, which has been brought on record by way of Annexure-2 to this application.
In view of the observations made by this Court in the said order dated 28.05.2015 passed in Criminal Miscellaneous No. 24474 of 2015, this application stands allowed. Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance North Bihar, Muzaffarpur in connection with Special Case No. 03 of 2015 arising out of Vigilance P.S. Case No. 10 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner
Patna High Court Cr.Misc. No.32400 of 2015 (2) dt.13-08-2015 3/3 shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
