2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406 and 420 of the Indian Penal Code.
3 . By filing a supplementary affidavit on behalf of the petitioner it is stated that though petitioner is alleged to have defalcated the amount of Rs. 8,37,547/- but the insurance company have already given the insured amount of Rs. 79,2599/- and the petitioner is ready to pay the rest amount of Rs. 44948/- to the Ashish Motor Hero Agency Katihar in
Patna High Court CR. MISC. No.55774 of 2022(9) dt.19-09-2023 2/3 installments.
4. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned C . J . M, Katihar in connection with Katihar Town P.S. case no. 81 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure , in the light of following conditions: A. Petitioner is directed to deposit Rs. 22,948/- ( Rupees Twenty Two Thousand Nine Hundred forty eight) at the time furnishing bail-bond through Bank Draft in favour of M/S Ashish Motor Hero Agency Katihar.
B. Rest amount of Rs. 22,000/- ( Twenty Two Thousand) be paid in 2 equal installments i. e . at the rate of Rs. 11,000/- (Eleven Thousand) per installment within a period of six months from the date of furnishing bail-bond. C. If petitioner fails to comply with the aforesaid direction of this Court, the court below is free to cancel the bailbond of the petitioner. 5 . It is made clear that without going into merit of
