The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. It is alleged that an imposter got opened account in the name of Phulkali Devi Wife of Akalu Sah the actual prospective beneficiary under Indira Awas and by virtue of the same Rs.35,000/- under Indira Awas scheme was transferred into the account of an imposter. It is alleged that petitioner was Branch Manager of Central Co-operative Bank, Sheohar at the relevant time.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.35981 of 2015 (2) dt.07-09-2015 2/2 petitioner that the fraud was detected and subsequently the money was recovered and was transferred to the account of actual beneficiary Phulkali Devi in Vijaya Bank, Sheohar Branch.
Considering the fact that the money was recovered from the imposter's account and transferred to the account of actual beneficiary, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 228 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
