ANJANA MISHRA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the BSFC as well as the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Banka P.S. Case No.228 of 2015 for allegedly having committed the offence under Sections 406 and 420 of the Indian Penal Code.

On the past few occasions, this Court, after considering the entire facts and circumstances of the case, had been pleased to extend the benefit of interim relief to the petitioner with an intention that the learned counsel for the Bihar State Food Corporation would verify and bring before

Patna High Court Cr.Misc. No.32626 of 2015 (5) dt.16-12-2015 2/2 this Court documents controverting the contents made in the supplementary affidavit filed by the petitioner. However, the issue remains open even on date.

Considering the fact that the petitioner has pledged the properties in favour of the BSFC to secure advances made to him and that there being no material to controvert the said submission, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No.228 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
