Petitioner, already in custody, seeks bail in connection with Falka (Pothia) PS Case No.03 of 2014, registered under Section 364 of the Indian Penal Code.
Allegation is that some unknown person kidnapped the driver of the informant along with the tractor and later on his dead body was found.
Learned counsel for the petitioner submits that except disclosure of name of the petitioner in the confessional statement of Sushil Mandal that he is also involved and sold the tractor to somebody, there is no other material and the tractor has not been recovered from his possession nor any incriminating piece of evidence leading to his confessional

Having considered the aforesaid facts and circumstances, petitioner Manik Lal Mandal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-5, Katihar in connection with Falka PS Case No.03 of 2014 with following conditions:
(1) One of the bailors must be the close family member of the petitioner.
(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
