JUSTICE SHAILENDRA SINGH ORAL ORDER 09-11-2022 The present Criminal Miscellaneous petition has been filed for the restoration of Cr. Misc. No. 19654 of 2022, which was dismissed for want of prosecution vide order dated 12.09.2022. It is submitted by learned counsel appearing for the petitioner that the In-charge of the said case namely Shri Ritwik Thakur all of sudden fell ill and was admitted in Jay Prabha

Patna High Court CR. MISC. No.54695 of 2022(2) dt.09-11-2022 2/2 Medanta Hospital in the evening of 10.09.2022 and he was discharged in the evening of 11.09.2022 and thereafter he was under the visit and watch of Doctor for about week. Due to aforesaid reason no one appeared on 12.09.2022 although there were other learned counsels also namely, Nilesh Kumar and Shivam but unfortunately Nilesh Kumar has also not come to court.

Heard both the sides and perused the record.

For the reasons mentioned above, I find substance in the above mentioned prayer and accordingly the present petition stands allowed and the Cr. Misc. No. 19654 of 2022 is directed to be restored to its original position.
