JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 379, 385 and 504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. It is alleged that the petitioners obstructed the informant in construction of public road, abused by calling caste name and snatched `5,000/-.

It is submitted by learned counsel for the petitioners that notices were issued under Section 41(A) of the Cr. P.C. since arrest of the petitioner was not required by the police.

Patna High Court Cr.Misc. No.25789 of 2015 (2) dt.17-07-2015 2/2 It is submitted by learned counsel for the petitioners that the informant was using to cutting soil from the land of the petitioner and when protest was made, the present case was lodged by the informant.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with N.H. Bangra P.S. Case No. 94 of 2014 pending in the court of learned CJM, Samastipur. Accordingly, the application is disposed of.
