Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his minor daughter aged about 15 years fled with the petitioner.

It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the informant himself alleges that his daughter eloped with the petitioner, which amply demonstrates that the petitioner and the

It is further submitted that victim had come back and her statement was recorded under Section 164 Cr.P.C. wherein she has disclosed her age as 19 years, but then she was medically also examined wherein the doctors have assessed her age in between 15-16 years, it is next submitted that informant has managed the medical report. It is also submitted that when the statement of the victim was being recorded before the learned Magistrate and she disclosed her age as 19 years and if the learned Magistrate would have felt that the victim is not a major in that event the learned Magistrate himself would have given his opinion regarding the age of the victim. It is also submitted that the victim is a major and she has married the petitioner and is pregnant. It is also submitted that informant realising his mistake has also compromised the case. 5.

Learned counsel for the informant does not oppose the anticipatory bail application of the petitioner. 6.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount
