Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 212, 216, 323, 324, 325, 326, 307, 353, 302, 332, 333, 435, 120B, 379 of the Indian Penal Code, Section 27 of the Arms Act, Section 3/4/5 of the Explosive Substances Act, Section 17 of the Criminal Law Amendment Act and Sections 10, 11, 13(1)(2) of The Unlawful Activities(Prevention) Act, 1967.
The prosecution case is that when the police force started combing operation against the naxals then 26 accused persons including the petitioner were found keeping surveillance to the activities of the police force. Subsequently due to land mine blast Gulab Yadav and Hawaldar Narrotam Das succumbed to the injuries.
Patna High Court Cr.Misc. No.34984 of 2015 (2) dt.18-08-2015 2/2 It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The petitioner was elected member of Panchayat Samiti, Dumriya Anchal from 2001 to 2011.
Considering the suspicious nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Dumariya P.S. Case No. 12 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Sherghatti, Gaya.
Accordingly the application is disposed of.
