Petitioners, already in custody, seek bail in connection with Kumarkhand PS Case No.131 of 2017, registered under Sections 341, 323, 447, 324, 307, 380, 504 and 506/34 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that on account of trivial issue Santan Yadav is said to have opened fire causing injury on the left hand of the son of the informant and Ashok Yadav gave farsa blow on his right hand.
Learned counsel for the petitioner submits that the occurrence was committed on trivial issue of giving the calf of the cow and no corresponding injury on the hand of the son of
Patna High Court Cr.Misc. No.13500 of 2018(3) dt.25-04-2018 2/2 the informant was found and the injury found on the son of the informant is attributed to petitioner no.2, which is simple in nature, not on the vital part of the body and petitioner no.2 has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioners, namely, Ashok Yadav and Santan Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Madhepura in connection with Kumarkhand PS Case No.131 of 2017.
