The petitioner is in custody in connection with NDPS Case No.28 of 2017 arising out of Ara Nawada P.S.Case No.315 of 2017 registered for an offence under Sections 8(c)/20(b)(ii)c of the NDPS Act.

It is alleged that in course of raid in a train, the police party apprehended this petitioner and two others and seizued ganja from their possession in different gunny bags. This petitioner was found carrying 14 Kg. of ganja.

Learned counsel for the petitioner submits that the petitioner was apprehended merely on suspicion as at the relevant time he was traveling with one Kamlesh Paswan. The petitioner has been roped in this case at the instance of the persons who are

Patna High Court Cr.Misc. No.62922 of 2017 (2) dt.10-01-2018 2/2 hostile to the petitioner because of village politics. The petitioner is in custody since 08.08.2017 having clean antecedent. It has further been submitted that similarly situated co-accused Satendra Kumar who was also arrested has been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.50404 of 2017. Learned APP opposed the submissions.

Considering the case of this petitioner on similar footing, facts and circumstances of the case, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Bhojpur, Arrah in connection with NDPS Case No.28 of 2017 arising out of Ara Nawada P.S.Case No.315 of 2017 subject to condition that one of the bailors shall be the own relative of the petitioner.
