Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 307, 120(B)/34 of the Indian Penal Code and under Section-27 of the Arms Act.
Petitioner is named in the first information report but according to prosecution case itself, FIR named accused persons made indiscriminate firing, committing murder of the deceased of the present case. So far as petitioner is concerned; it is admitted case of the prosecution that he was not present on the place of occurrence, when the murder of deceased of the present case was committed rather he was present in Sitamarhi court and it is only
Patna High Court Cr.Misc. No.12329 of 2016 (2) dt.17-03-2016 2/2 stated that he along with some others had given threatening to commit murder.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Runni Saidpur P.S.
