The petitioner seeks regular bail in connection with Naugachia P.S. Case No. 168 of 2017, G.R. No.981 of 2017 for the offences punishable under Sections 341, 323, 504, 506, 379, 427, 302/34 of the Indian Penal Code.

The case of the prosecution is that the daughter of the informant assaulted her mother upon which, the son of the informant turned up to pacify them and in the meantime son-in - law of the informant started abusing and assaulting the son of the informant whereafter the son of the informant succumbed to injury after few days.

Learned counsel for the petitioner submits that as far as the petitioner is concerned there is general and omnibus

Patna High Court Cr.Misc. No.20150 of 2018 (3) dt.17-05-2018 2/2 allegation against him and deceased died on account of septicemia since proper treatment was not given to him. It is further submitted that the similarly situated co-accused namely Md. Kalam has been granted bail by this Court by order dated 16.03.2018 passed in Criminal Miscellaneous No.8426 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 2nd, Naugachia, District Bhagalpur in connection with Naugachia P.S. Case No. 168 of 2017, G.R. No.981 of 2017.
